These Terms of Service ("Terms") govern your access to and use of bergboysdigital.com (the "Site") operated by Berg Boys Digital ("we," "us," or "our"), as well as any digital marketing or local SEO services (the "Services") we provide. By accessing the Site or engaging our Services, you agree to be bound by these Terms.

Use of the Site

The Site is provided for informational purposes and to facilitate engagement with our Services. You agree to use the Site only for lawful purposes and in a manner that does not violate the rights of, restrict, or inhibit anyone else's use.

Services, Pricing, and Guarantee

Our standard engagement is a $497 one-time onboarding fee plus $997 per month. We may offer promotional pricing — for example, 20% off the first three months for clients who sign within 3 days of their audit call. Promotional terms must be accepted in writing and are not retroactive.

90-Day Lead Growth Guarantee: We commit to delivering measurable lead growth within 90 days of Service commencement. If we fail to deliver measurable progress, we will continue working without additional monthly fees until progress is measurably achieved, subject to the good-faith participation of the Client. Measurable progress is defined in the engagement Scope of Work and generally includes ranking improvements, traffic lift, or lead volume growth.

Intellectual Property

All content on the Site, including text, images, logos, and code, is owned by Berg Boys Digital or our licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our express written permission.

Deliverables we create for Clients (e.g., written content, landing page copy) become the Client's property upon full payment of the applicable engagement fees.

Third-Party Platforms

Our Services frequently interact with Google, Bing, Meta, and other third-party platforms. We do not control those platforms, cannot guarantee their policies, and are not responsible for platform-specific outcomes outside our direct control (e.g., manual actions by Google).

Disclaimer and Limitation of Liability

The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied, except as stated in the written engagement agreement (which includes the 90-Day Lead Growth Guarantee above). To the maximum extent permitted by law, Berg Boys Digital's aggregate liability for any claim arising out of the Services shall not exceed the total fees paid by Client during the three (3) months preceding the claim.

Termination

Either party may terminate an engagement with 30 days' written notice. Fees paid for the current month are non-refundable except under the 90-Day Lead Growth Guarantee terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law rules. Any dispute shall be resolved in the state or federal courts located in Clark County, Nevada, and the parties consent to personal jurisdiction and venue there.

Changes to These Terms

We may update these Terms as our Services evolve or legal requirements change. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Site or Services after changes constitutes acceptance.
