Terms of Service

These Terms of Service ("Terms") govern your access to and use of bergboysdigital.com (the "Site") operated by Berg Boys Digital ("we," "us," or "our"), as well as any digital marketing or local SEO services (the "Services") we provide. By accessing the Site or engaging our Services, you agree to be bound by these Terms.

Use of the Site

The Site is provided for informational purposes and to facilitate engagement with our Services. You agree to use the Site only for lawful purposes and in a manner that does not violate the rights of, restrict, or inhibit anyone else's use.

Our collection and use of personal information through the Site — including analytics and advertising tools — is described in our Privacy Policy.

Services, Pricing, and Guarantee

Our standard engagement is a one-time launch fee starting at $497 — the exact fee is set by a technical site assessment and quoted in writing before signing — plus $997 per month for a single-location engagement. Some rebuild engagements split the launch fee into two installments (for example, $997 at signing and $497 at the end of the first month); any installment schedule is stated in the written quote. A combined SEO + Google Ads engagement is $1,747 per month; multi-location engagements start at $2,497 with $750 per month per additional location. We may offer promotional pricing — for example: Sign within 5 days of your audit and we take $497 off your launch fee. Then $997/month, flat. Promotional terms must be accepted in writing and are not retroactive. Pricing changes apply to new engagements only: existing clients keep the pricing in effect when they signed, unless both parties agree otherwise in writing.

90-Day We-Work-For-Free Lead Guarantee: We commit to delivering measurable lead growth within 90 days of Service commencement. If we fail to deliver measurable progress within 90 days of Service commencement, the Client is entitled to a refund of the monthly management fees paid for that initial 90-day period, subject to the good-faith participation of the Client. Measurable progress is defined in the engagement Scope of Work and generally includes ranking improvements, traffic lift, or lead volume growth.

Get Digital Tier: $497 one-time website build + $97 per month for hosting, domain management, up to 2 small content edits, and founder-led support. Get Digital does not include Google Business Profile setup, ranking work, paid ads, or the 90-day lead guarantee; those are only available on the $997/month tier. Prepay options: Quarterly ($249/3mo), Semi-annual ($469/6mo), Annual ($849/12mo). Prepaid plans are non-refundable. Sites hosted on a Berg Boys subdomain remain hosted by Berg Boys Digital and are taken offline if the plan lapses after a 14-day grace period.

Intellectual Property

All content on the Site, including text, images, logos, and code, is owned by Berg Boys Digital or our licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our express written permission.

Deliverables we create for Clients (e.g., written content, landing page copy) become the Client's property upon full payment of the applicable engagement fees.

Third-Party Platforms

Our Services frequently interact with Google, Bing, Meta, and other third-party platforms. We do not control those platforms, cannot guarantee their policies, and are not responsible for platform-specific outcomes outside our direct control (e.g., manual actions by Google).

Disclaimer and Limitation of Liability

The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied, except as stated in the written engagement agreement (which includes the 90-Day We-Work-For-Free Lead Guarantee above). To the maximum extent permitted by law, Berg Boys Digital's aggregate liability for any claim arising out of the Services shall not exceed the total fees paid by Client during the three (3) months preceding the claim.

Termination

Either party may terminate an engagement with 30 days' written notice. Fees paid for the current month are non-refundable except under the 90-Day We-Work-For-Free Lead Guarantee terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law rules. Any dispute shall be resolved in the state or federal courts located in Clark County, Nevada, and the parties consent to personal jurisdiction and venue there.

Changes to These Terms

We may update these Terms as our Services evolve or legal requirements change. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Site or Services after changes constitutes acceptance.
